Is there anything i can do, ive been told its very possible they may have to let me go. and that isnt good but is there anything i can put to them like endo and dda or unfair dismissal if its only me that gets booted?

also if it does happen are there any benefits that i claim i don have a clue what i could apply for. have tried to speak to cab but been told 6 month wait for appt due to credit crunch and so many people wanting help.

I think you have a case for unfair dissmissal, but I believe you need to have worked there a year to claim, as so I was advised by my union rep, when I was in a similar situation having worked in a job a matter of weeks.

I know my Dad would know how the law stands having been a union rep himself, unfortunately he's no longer here to ask.

i dont know the rules for unfair dismissal due to endo etc.......when i had the twins in feb 07 i was gonna go back to work after having 6 months maternity and then taking 6 months unpaid - my endo flared up so so so bad since c section that i handed in my notice.....i claimed for incapacity benefit as unfit for work - and got it = you get 68 quid a week for 6 months and now get 75 quid a week - doc has to sign a "unable to work" form,,,,,i saw rheumatoligist yesterday and also maybe have arthritis in hands and feet - gotta have tests etc...........i did also apply for disability allowance (per benefits lady advice) but they turned me down as according to them endo is period pain....!!!!...have done other ANGRY threads about this.............they turned me down on the hand stuff cos they said i could prepare a meal !!!!.....
the benefits system is really complicated - this is the first time i have ever tried to claim for anything and its form after form after form,,,,,,
get looking on the internet sites......
good luck

Think il have to try and get docs to do the unable to work route. thanks for the advice.

HI Catseyes, I went from being a full time carer for my disabled husband, we mutually agreed to eparate/divorce, to being unemployed, then I had the jobs doing care work as mentioned above, and then back to claiming JSA again, until the pressure became so much, applying for job after job and being turned down, I was often sending off 2-3 apps a week.
I was getting stressed and depressed, and my boyfriend advised me to go to the doctors and get signed off sick, about three weeks later my gynae prob came to light. I'm of sick awaiting diagnosis. My counsellor also reckons I could be suffering PTSD, posibly due to past events in my life and also this daily pain caused by this gynae prob.

I know my ex was medically retired, as his union rep advised him to go of sick, he had the beginnings of progressive MS, as otherwise his manager would try and presure him into accepting voluntary redundancy.
I know form his experience that your employer CANNOT sack you or force you to accept voluntary redundancy whilst off sick. This was back in '94, I take it that law still stands. I know you're not a train driver, but I could maybe ask my ex (we remain friends) to ask one of the ASLEF reps
he/I know.
If you're not well enough to continue working I would claim SSP, until that runs out and then apply for Incapacity Benefit, depending on your NI contributions also apply for Income Support due to incapacity. That's what one of the Jobcentre staff advised me to do, if you can't claim IB, then depending on how much income is coming into your household, I don't see they can refuse IS, unless for example you've a millionare husband, (unlikely I know).

I think im def gonna have to look into getting docs to sign me off full time, am just waiting on what wor are gonna do regards the redundancy and keep claiminh ssp until an answer has been given.
After im laid off as expecting to be i will go from there, i have looked into ib but even though h2b isnt a millionaire they say he earns too mcuh for me to get any added help. His wage doesnt cover mortage and bills!!
